A reminder of which Key Features Document to use to meet regulatory requirements

With effect from 14 January 2005 Pure Protection products became regulated by the FSA under the Insurance Conduct of Business Sourcebook (ICOBS).

For products subject to ICOBS † regulation it is a requirement that the associated Key Features Documents, include a FSA ‘key facts’ logo.

†ICOBS products include all Term Assurance (excluding those stated under COBS below), Critical Illness Cover, Family Personal Income Plan, Mortgage Payment Insurance and Income Protection Benefit.

Any Key Features documents for protection products that remain subject to the existing Conduct of Business Sourcebook (COBS*) must not include the ‘key facts’ logo.

*COBS protection products include Whole of Life and Term products which go past age 70 with a term of 10 years or more or where a conversion option is included.

It is important to use the correct Key Features Documents and:

 Ensure that any customer, who is sold an ICOBS    protection product, receives a Key Features Document    that includes the ‘key facts’ logo.
 
   Ensure customers who are sold a COBS protection    product do not receive a Key Features Document with    the ‘key facts’ logo.

Not using the correct literature could lead to a breach of FSA regulations. The possible consequence of this is that it is likely that the correct documentation would be required to be supplied and explained to your client, resulting in additional work, time and effort as well as possibly damaging your reputation.

The correct Key Features Documents for each type of Legal & General protection product are shown below.

Pure Protection product (ICOBS)
